10. Creditworthiness and transmission to credit agencies

10.1. We allow our customers to purchase goods using insecure methods of payment (e.g. purchase on credit terms).

10.2. Companies that generally grant their customers insecure payment methods have a legitimate interest in protecting themselves against the occurrence of payment defaults. This is achieved, among other things, by checking the customer’s creditworthiness before granting the option of using insecure methods of payment. The credit agency attains the stored data primarily from publicly accessible sources, such as the Internet, public registers, e.g. the commercial register (master data), the Bundesanzeiger / German Federal Gazette (published balance sheets), business registers (non-published balance sheets), public notifications and information from cooperation partners, companies themselves (research/self-surveys, data updates), insolvency notifications (insolvencies), insolvency registers, trade offices, chambers of commerce and industry, official gazettes, published balance sheets and annual financial statements, debtor register data, payment experiences, and public sanctions lists of the EU, USA and other countries. To obtain creditworthiness information, the following data is transmitted to D&b: correct company name, location and, as far as available, Duns number. 10.5. As part of the credit assessment, we are entitled to decide whether to grant our customer the desired insecure payment method (invoice payment), or not. The transmission of a negative credit report by a credit agency, for example, may result in a rejection of the desired payment method.

10.6. The customer may assert the right against us to have us review the decision. Furthermore, the customer has the right to present his/her own point of view and the right to contest the decision.

10.7. The processing of data in the context of the credit assessment is based on Article 6(1)(b) GDPR and Article 6(1)(f) GDPR. We have, in principle, a legitimate interest in carrying out a credit check when you select an insecure payment method (instalment/invoice purchase).
